Under the law the cost of the drain must be determined by the engineer in laying it out. There is an express provision in the Bill that the two engineers -the one named by the landowner and the company's engineer-shall meet to consider the proportion of cost to be borne by the company, and in the event of their failure to agree, the matter will be referred to a county court judge. I do not say that the Bill is perfect in its form, but if there are any little discrepancies they can be removed in committee.

In reply to my hon. friend from Lanark (Hon. Mr. Haggart) I may say that I have examined the Bill myself and have submitted it to the officers of my department, and we have come to the conclusion that there is absolutely nothing in it which is not quite within the powers of this parliament.
