Section 11 of the Canada Customs Tariff, 1907, provides that;-"The importation into Canada of any goods enumerated, described or referred to in schedule C to this act is prohibited; and any such goods imported shall thereby become forfeited to the crown and shall be destroyed or otherwise dealt with as the Minister of Customs directs; and any person importing any such prohibited goods, or causing or permitting them to be imported, shall for each offence incur a penalty not exceeding two hundred1 dollars."

Item 1201, schedule "C" of the Customs Tariff, 1907, classifies as prohibited goods:- "Books, printed paper, drawings, paintings, prints, photographs, or representations of any kind of a treasonable or seditious, or of an immoral or indecent character."

Collectors or other customs officers seize goods which are obviously immoral or indecent, and if their importation is general, as in the case of a publication, a circular is issued prohibiting its importation into Canada. Imported publications, concerning which doubt exists, are forwarded to the department by collectors, and other persons, and are carefully examined. If found to be of the character set forth in item 1201 of the tariff, they are prohibited.

Post Office Department Undesirable publications are being prohibited transmission in the mails under paragraph (d) subsection 1 of section 9 of the Post Office Act as amended in 1913.
