BUSINESS OF THE HOUSE

Mr. T. L. CHURCH (Toronto Northwest) moved, seconded foy Mr. Thompson: That on Friday, June 1, Bill No. 63, to amend the Railway Act (Investigation of subsidiary of telephone or telegraph companies) now under public bills and orders, be given precedence over all (a) private bills; (b) public bills and orders; (1) during the hour devoted to private bills and (2) over all other business until disposed of on that evening.

LIB

Ernest Lapointe (Minister of Justice and Attorney General of Canada)

Liberal

Hon. ERNEST LAPOINTE (Minister of Justice):

I am sorry that the Prime Minister is not in his seat at the present time, but I have to take the stand which he has already taken with regard to similar matters. I think it would be unfair to other measures which have precedence over this to accept the motion of my hon. friend. If the bill comes up in due course at its proper stage, it will certainly be considered, but we cannot agree to give it precedence over other measures.

Mr. CHURCH:

It is not being unfair to

other members to give precedence to this bill which has been on the order paper since February. I have a bill which has been standing on the order paper since early in February. This is not a free parliament unless we can bring these questions before it.

Mr. SPEAKER:

The motion is out of

order. The other day I ruled that according to May and Bourinot any motion concerning the order of business of the house should be made by the Prime Minister or the leader of the house.

Mr. SPEAKER:

It matters not whether

the hon. gentleman gave notice or not. The question is: Is the motion in order? I contend, and May supports my contention, that any motion concerning the order of business of the house must be moved by the leader of the house. I have so decided and I now so rule.
