THIRD SESSION- TWENTIETH PARLIAMENT-OPENING


The parliament which had been prorogued on the thirty-first day of August, 1946, met this day at Ottawa, for the dispatch of business. Mr. Speaker read a communication from the Governor General's secretary announcing that His Excellency the Governor General would proceed to the Senate chamber at three p.m. on this day, for the purpose of formally opening the session of the dominion parliament. A message was delivered by Bonner Larose, Esquire, Acting Gentleman Usher of the Black Rod, as follows: Mr. Speaker, His Excellency the Governor General desires the immediate attendance of this honourable house in the chamber of the honourable tlie Senate. Accordingly the house went up to the Senate chamber. And the house having returned to the Commons chamber:

I have the honour to inform the house that during the recess I received communications from several members notifying me that the following vacancies had occurred in the representation, viz.:

Of Honourable Pierre Joseph Arthur Cardin, member for the electoral district of Richelieu-Vereheres, by decease;

Of William Chisholm Macdonald, Esquire, member for the electoral district of Halifax, by decease.

I accordingly issued my several warrants to the chief electoral officer to make out new writs of election for the said electoral districts, respectively.

I have the honour to lay before the house court judgments in connection with the imprisonment of Fred Rose, M.P., namely (1) a true copy of the verdict and sentence in the case of Fred Rose; (2) copy of the certificate of the clerk of the court attesting the said verdict and sentence;

(3) copy of the judgment of the court of King's Bench, Appeal side, rejecting the appeal and maintaining the verdict; (4) copy of the judgment of the court of King's Bench, Appeal side, rejecting the appeal and confirming the sentence.

WRIT ORDERED FOR ELECTION OF NEW MEMBER


Right Hon. W. L. MACKENZIE KING (Prime Minister): Mr. Speaker, I beg to move, seconded by Mr. St. Laurent: That Fred Rose, member for Cartier, having been adjudged guilty of an indictable offence and sentenced to six years' imprisonment and not having served the punishment to which he was adjudged, has become and continues incapable of sitting or voting in this house, and it is ordered that Mr. Speaker do issue his warrant to the chief electoral officer to make out a new writ for the election of a new member to serve in the present parliament for the county of Cartier in the room of said Fred Rose adjudged and sentenced as aforesaid. This resolution speaks for itself. I have nothing to add. Motion agreed to.

Right Hon. W. L. MACKENZIE KING (Prime Minister) moved for leave to introduce Bill No. 1, respecting the administration of oaths of office. Motion agreed to and bill read the first time.
