No, but it is quite possible to make the punishment altogether out of proportion to the crime. There was a time in the old country when under the law a man could be hanged for stealing sheep, but no one was hanged because they could not get a conviction. If you make the punishment too drastic it will be impossible to obtain a oonviction.
